Maryland probate law is administered at the county level, with the state providing the legal framework.

Maryland's probate system follows a structured process that depends on the size and complexity of the estate. Understanding the thresholds, proceedings, and roles involved is essential for anyone serving as a personal representative in the state.

When Is Probate Required?

In Maryland, the estate must go through probate if the value of the estate assets exceeds the decedent's debts. The process begins at the county Register of Wills office, where the will is filed and the personal representative is appointed.

The Small Estate Threshold

Estates valued at $50,000 or less qualify as small estates under Maryland law. If the spouse is the sole heir, the threshold increases to $100,000. Small estates are eligible for simplified distribution, which significantly reduces the administrative burden.

Types of Probate Proceedings

For straightforward estates greater than $50,000 (or $100,000 with a spouse as sole heir) that are not contested, the estate can go through administrative probate. This is handled by the county Register of Wills and does not require Orphans' Court involvement. More complex cases, including contested wills or estates with significant debts, may require Orphans' Court proceedings.

Will vs. No Will

If the decedent left a will, the personal representative is typically the person named in the will. If there is no will, the court follows Maryland's intestacy laws to determine who is entitled to serve and how assets are distributed. The intestacy laws prioritize spouses, children, parents, and siblings in a specific order.

Role of the Personal Representative

The personal representative is responsible for paying valid debts and taxes, then distributing assets according to the will or intestacy laws. This includes inventorying all assets, maintaining insurance, managing property, and providing a full accounting to the court.

Real Estate in Probate

If the estate includes real property that needs to be sold, the process requires court oversight. The property must be appraised, the sale must be conducted at fair market value, and the court must approve the transaction. Working with a probate real estate specialist who understands Maryland's requirements is essential.

"Maryland's probate system is structured, but the details matter. The difference between administrative probate and Orphans' Court proceedings can be the difference between a three-month process and a year-long one."

How the Probate Value Analysis™ Helps You Make Informed Decisions

As Personal Representative, you carry a fiduciary duty to protect the value of the estate. Every decision you make about the property, whether to sell as-is, make repairs, or list on the open market, has financial consequences for the heirs and beneficiaries.

The Probate Value Analysis™ is designed to give you the complete picture before you commit to any path. Instead of guessing at the numbers or relying on a single data point, you get eight specific, actionable data points that cover every angle of the property's value and market position.

A Clear Property Value Comparison

Compare an agent's opinion of current market value, potential preparation costs, and estimated sale proceeds to help the family evaluate its options. This market analysis is not an independent appraisal or a guarantee of court acceptance. Your estate attorney or CPA can advise when a qualified appraisal is needed.

Maximize Estate Value

By comparing as-is value against after-improvement value, you can make an informed choice about whether repairs or staging will generate a strong return for the estate.

Transparent With Heirs

The analysis helps you explain the recommended strategy to all beneficiaries clearly, with documented reasoning they can understand and trust.

Avoid Costly Delays

Making the right decision the first time saves months of court delays and prevents the property from sitting vacant, losing value while the estate carries holding costs.
